CJ bothered by "ghost that walks"

Tuesday, June 30, 2009

Chief Justice Michael Kruse has ordered that the government subpoena immigration officers to appear before the court to explain the status of  a man who entered the territory on a 30 day permit yet the immigration office does not have any record of his arrival.

The probation office discovered that the defendant, Misiaita Aiono is using another person’s name.  Kruse said if not for the actions of the probation office this would not have come to light and would be swept under the rug.

According to the government the defendant served five years in prison after he was convicted of having sex with a minor. Kruse said the court is bothered by cases such as these because it seems to be happening a lot and its clear the government system is not working.

Kruse wants to know who was behind the defendant using another person’s identity…his family or the government.  He said the real identity of the defendant is not known and it seems we have a ghost that walks.

The Chief Justice ordered Assistant Attorney General Lisa Teesch MacGuire to subpoena immigrations officers and have them bring all immigration records for the defendant.  A status hearing is set for July 13.
