Governor intervenes in doctors' licensing

Governor Togiola Tulafono has ordered the Hospital Authority Board not to take any action against doctors who remain uncertified according to US standards.  

In an executive order issued last night the governor ordered a 60-day stay on a policy of the Hospital Authority Board that beginning July 1st,  it will no longer employ health care providers who are not licensed in accordance with the laws of the territory. June 30th was the deadline that the Hospital Authority Board had given doctors at the hospital to comply with the United States Medical Licensure Examination.  

The preamble of the executive order states that the governor is informed that an impending crisis is at hand that endangers the public health, safety and welfare. The majority of health care providers have not applied for nor have received US certification  and the intended action by the Hospital Authority to no longer employ them beginning July 1, would leave only a mere fraction of health care providers at the territory’s only hospital.  

It said this impending crisis occurs in the midst o a pandemic, and represents a major and imminent threat the public health, safety and welfare of residents.

The executive order directed the Hospital Authority Board to stay the pending action against doctors who remain uncertified according to US standards.  It ordered the American Samoa Health Regulatory Services Board to convene immediately to consider specifically the case of doctors in this category.  

The Health Regulatory Services Board was also ordered to provide to the governor within 30 days rules for the licensure of health care providers who do not currently comply with the territory’s licensure laws. The rules shall be prepared for adoption and promulgation after review by the governor, pursuant to the Administrative Procedures Act.  

During the stay period the Hospital Authority Board shall take no action which shall impair the review and final determination of reasonable rules to govern the licensure of health care providers.  And the Hospital board shall not take any adverse action against any health care provider, pursuant to this policy.
