Governor signs bill to pay court settlement

Friday, May 2, 2008

ASG can finally pay a 2006 High Court judgment for the death of a woman who died at the hospital after giving birth to twins in 2001.

Governor Togiola yesterday approved an appropriations bill of $147,230, approved by the Fono in its last regular session to cover the judgment. Mr. Leasuasu Tupuono claiming negligence on the hospital’s part in treating his wife, Simala Tupuono sued the government in 2003 over her death. Mr. Tupuono had to seek relief from the court last year when ASG had still not paid up the September 2006 judgment. He petitioned that the court order LBJ directly to pay the judgment instead of ASG. But the court found that LBJ was not a properly named defendant.
