Matai bill proposed

There’ll be added criteria for the court to consider when deciding matai title cases in dispute under a new administration bill.
Governor Togiola Tulafono said at the opening of the new Fono session this morning that there’s a worrying trend with families not wanting to deliberate on successors to vacant matai titles but are rushing to the courts. He said the legal system has become an avenue for removing a basic ingredient of the faasamoa and matai system: family consensus, cooperation and negotiation. Under the proposed bill, new criteria will be added for the court to consider in awarding matati titles. The new criteria place more emphasis on the family’s decision as to who shall occupy the title. This legislation also removes from the court’s consideration, the premise of blood quantification. One intent of this bill said the governor is to replace this antiquated method of determining a claimant’s right to hold the family title with a simpler inquiry which only requires that a recognized blood connection to the title be established. The governor said that the framework for the matai title bill will be submitted to the Fono for input and review.
